Terms of Service for Eat No Solo

1. Introduction

Welcome to Eat No Solo. These Terms of Service ("Terms") govern your use of the Eat No Solo mobile application ("App") operated by Zila Shniderman ("we," "our," or "us").

By creating an account or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

2. Eligibility

To use Eat No Solo, you must:

  • Be at least 18 years of age
  • Be capable of forming a binding contract
  • Not be prohibited from using the App under applicable law
  • Not have been previously banned from the App

3. Account Registration

To use the App, you must create an account and provide accurate, complete information. You are responsible for:

  • Maintaining the confidentiality of your login credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use

We reserve the right to suspend or terminate accounts that contain false or misleading information.

4. Description of Service

Eat No Solo is a social platform that connects users to share meals together. The App allows you to:

  • Create a profile with your interests and preferences
  • Discover and match with other users in your area
  • Create or join dining meetings at restaurants
  • Communicate with other users through in-app messaging
  • Rate and review your dining experiences

5. User Conduct

You agree to use the App responsibly and not to:

Prohibited Behavior:

  • Harass, threaten, or intimidate other users
  • Post false, misleading, or fraudulent information
  • Impersonate another person or entity
  • Use the App for commercial purposes without authorization
  • Collect or harvest user data without consent
  • Upload viruses, malware, or malicious code
  • Circumvent security features of the App
  • Use the App for illegal activities

Meeting Etiquette:

  • Attend meetings you have confirmed
  • Cancel meetings in advance if you cannot attend
  • Treat other users with respect during meetings
  • Not engage in dangerous or illegal behavior during meetings

6. User Content

You retain ownership of content you post (photos, messages, reviews). By posting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content within the App.

You are solely responsible for your content and agree not to post:

  • Content that infringes intellectual property rights
  • Offensive, discriminatory, or hateful content
  • Sexually explicit material
  • Personal information of others without consent
  • Spam or promotional content

We may remove content that violates these Terms without notice.

7. Ratings and Reviews

Users may rate and review other users after meetings. You agree that your ratings and reviews will be:

  • Based on genuine experiences
  • Fair and accurate
  • Not used to harass or defame others

We reserve the right to remove ratings or reviews that violate these Terms.

8. Premium Features

We may offer premium subscription features. If you purchase a premium subscription:

  • Payment will be charged to your app store account
  • Subscriptions auto-renew unless cancelled before the renewal date
  • No refunds for partial subscription periods
  • Pricing and features may change with notice

9. Safety and Meetings

Your Safety is Your Responsibility:

  • We do not conduct background checks on users
  • Always meet in public places
  • Inform someone of your meeting plans
  • Trust your instincts and leave if you feel uncomfortable
  • Do not share sensitive personal information with strangers

We are not responsible for:

  • The behavior of other users
  • Any incidents that occur during meetings
  • The accuracy of information provided by users or restaurants

10. Intellectual Property

The App, including its design, features, and content (excluding user content), is owned by us and protected by intellectual property laws. You may not:

  • Copy, modify, or distribute the App
  • Reverse engineer or decompile the App
  • Use our trademarks without permission
  • Create derivative works based on the App

11. Third-Party Services

The App may integrate with third-party services (Google Maps, restaurants, payment processors). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party services.

12. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

  • The App will be uninterrupted or error-free
  • The App will meet your expectations
  • Any information provided by users is accurate
  • Meetings will be safe or satisfactory

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

  • Indirect, incidental, or consequential damages
  • Loss of profits, data, or goodwill
  • Personal injury or property damage resulting from meetings
  • Actions or content of other users
  • Service interruptions or data loss

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim, or EUR 100, whichever is greater.

14. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your content or conduct
  • Your interaction with other users

15. Termination

By You: You may delete your account at any time through the App settings.

By Us: We may suspend or terminate your account at any time for:

  • Violation of these Terms
  • Conduct harmful to other users or the App
  • Extended inactivity
  • Any reason at our discretion with notice

Upon termination, your right to use the App ceases immediately.

16. Dispute Resolution

Governing Law: These Terms are governed by the laws of the European Union and the applicable member state where you reside.

Informal Resolution: Before filing a legal claim, you agree to contact us at eatnosolo@gmail.com to attempt to resolve the dispute informally.

Jurisdiction: Any disputes shall be resolved in the competent courts of your place of residence within the EU.

17. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes through the App or via email. Continued use of the App after changes constitutes acceptance of the new Terms.

18. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App.
